I acknowledge and agree that I must abide by the rules of the Saugatuck Harbor Yacht Club (the “Club”) while using its facilities: http://www.saugatuckharboryc.com/documents/10184/0/SHYC+Guest+Rules.pdf . Among other things, those rules require all children 12 years of age and under to wear at all times a Coast Guard approved life jacket while on the docks and be accompanied by an adult while on Club property.

I agree to assume all risks related to or arising out of the use of the basin, dock slip space assigned to me and other facilities of the Club and to release and hold harmless the Club, its members, officers, employees, agents, assigns, and successors in interest (the ""Released Parties""). I intend to release, in advance, and to waive my rights and to discharge all of the Released Parties from any and all claims for damages for death, personal injury or property damage which I or my guests or any other invitees may have, or which may hereafter accrue to me or my guests or other invitees, related to or arising out of such use, even though this liability may arise from negligence or carelessness on the part of the Released Parties, from dangerous or defective property or equipment owned, maintained or controlled by them, or because of their possible liability without fault. I understand and agree that this agreement is binding on my heirs, assigns and legal representatives. This agreement shall not apply to any claim against the Club covered by any in force policy of insurance purchased by the Club and tried or settled within the limits of liability of that policy; however, this agreement shall apply to, and the Club shall not pay, any amounts in excess of the amounts paid by the insurance carrier with respect to the claim.

I further give to the Club, its officers, employees and agents permission to take at any time any and all actions with respect to my vessel that they deem necessary to provide for the safety of the Club facilities or the safety of my vessel or any other vessel docked at the Club or under way in the Club basin.
